If anyone would like to come to Berkeley Video and Film Festival, its tomorrow night at the Oaks Theater on 1875 Solano Ave. There's a reception-y award-y party from 7-8.30, and then my movie 'Rain' will be playing at 8:45. I can't vouch for the quality of the subsequant movies, but they'll probably be very interesting and probably pretty different from your usual friday night movie. its $10 for students but if you contact me i may be able to get you in free.

AP Virgil students, don't forget snacks for E Block party. (Also, don't forget to check the website for the possible pop vocabulary quiz of Doom, unless you like to be unprepared like that.) Snacks typically are: artisan bread with olive oil, fancy olives, doughnuts and fried chicken. We like to be authentic. Plates and napkins are a bonus.

Everyone else: this is your day, too. Garlands and drapey white things are sort of Roman... Have fun but don't go out and kill any soon-to-be emperors because that would be WRONG.

For those of you who didn't get the announcement today, or who have graduated and therefore don't have to deal with this horseshit anymore, here's an update. Carl Thiermann and Co. have finally come up with a coherent, explicit internet use policy. Unfortunately, it's completely wrong.

Their bright idea--and I'll try and get a copy of the exact wording pretty soon--is that the school will not tolerate any "hateful, denigrating, libelous or slanderous" material on the internet, whether posted on or off campus.

Now, I'll try to word this as carefully as I can. Are these people completely fucking insane? It's incredible to me that, as many opportunities to consult with students as they had, and with the guide to the appropriate legal decisions that I was generous enough to give them, they still sorted through every possibility and managed to select the one that's exactly wrong.

They've had three chances on this (once when it first came up, once when they decided to hand out suspensions, and now this new policy), and all three times they've failed. As such, the following, which I dropped off for Thiermann in slightly edited form a couple of days ago, was faxed to the American Civil Liberties Union today:

so has there been any attempted response (administrative or individual faculty) by the adults as to why they're doing this to you? no one has had the balls to reply to anything on lj. i expect that the bulk of backlash won't matter to them, but i wonder if any of the intelligent commentary that's up on this community has affected them. I almost wanna conference call carl with the other 03's and ask him what the hell was he thinking and if he is going to make any adjustments. unless you guys know.

A. The short answer is yes. Mr. Chen regularly hassles people about things they've posted, and it's long been suspected--though never actually proven--that Enelow reads them too, probably cackling and correcting transition signals all the while.

Q. But... isn't that an invasion of privacy?
A. Oh, come on. You're posting it on the internet! If you actually want to keep something private, the internet is probably the worst possible place to put it. If teachers were breaking into your house and reading your diary, that would be something else altogether (as far as I know, Mr. Reinke has only done this once, so don't worry about it). But everyone's allowed to read it; there may be an 'unspoken rule' that teachers shouldn't snoop into students' lives, but I can think of exactly zero times when this rule has been followed. Especially the humanities teachers, for some reason they're all nosy sons'a bitches. As has been mentioned before, if you're that worried about it, delete any sensitive entries or make them friends-only.

Part Two: Yes, They Made Some Kid Delete His LJ

Q. They did?
A. Yup. It's common knowledge by now, but for completeness I will put it here: on or around February 2, a freshman (who I won't name here, you can find out if you really want to know) deleted his LJ, on pain of immediate expulsion. The offending posts contained 'hateful' (the Administration's word, not mine) language about the school and people there, and therefore was deemed unacceptable.

Q. You're joking.
A. I wish I was.

Q. But... but... freedom of speech!
A. Be very careful here. It's one thing to say 'OMG FREE SPEACH'; it's another to realize how the Free Speech Clause of the First Amendment works, and whether it actually applies. Let's look first at some cases when things like this have happened at other schools, and how courts have ruled on them.

The landmark case usually cited in this kind of disagreement is Tinker v. Des Moines. Way back in the sixties, a bunch of students wore black armbands to school to protest the Vietnam War, and got suspended for their efforts. In that case, the Supreme Court decided that student free speech was okay as long as it wasn't causing 'material and substantial interference' with school, and that 'in the absence of a specific showing of constitutionally valid reasons to regulate their speech, students are entitled to freedom of expression of their views'.

In Beussink v. Woodland R-IV School District, a student at a public school was suspended for ten days for criticizing a teacher on his personal web page. The court ruled that the school violated the student's First Amendment rights. Money quote: 'Disliking or being upset by the content of a student's speech is not an acceptable justification for limiting student speech'.

In Mahaffey v. Aldrich (scroll down a bit), a student at a public school posted 'hateful' material on his website, including a list of (gasp!) 'people I wish would die', and was summarily suspended. Again, the court ruled in favor of the student's right to freedom of speech.

Q. But wait! These are all public schools! And all the teachers are saying that since this is a private school, we don't have any right to free speech!
A. Not a question, but I'll let it slide. You're right; in private schools, a contract between the school and the parents (the thing you signed when they gave you the directory) dictates what rules students must follow, without any consideration of the First Amendment.

Q. So are we screwed?
A. No. In any other state, we would be. However, in the good ol' state of California, we have something called the Leonard Law (Calif. Educational Code Section 48950), which reads, in part:

School districts operating one or more high schools and private secondary schools shall not make or enforce any rule subjecting any high school pupil to disciplinary sanctions solely on the basis of conduct that is speech or other communication that, when engaged in outside of the campus, is protected from governmental restriction by the First Amendment to the United States Constitution...


What this boils down to is this: students in private schools in California enjoy the same First Amendment rights as anybody else does. As long as speech meets the Tinker standard (of not substantially interfering with the operation of the school), students in California private schools have the right to free speech.

Q. So expelling anyone for something on an LJ would be unconstitutional, wouldn't it?
A. Yes. Yes it would.

Dear Mr. Thierman,

Now, I had you for English in 10th grade and I bought you a Mr. T shirt with my own money. I bought it with my own $20 and said it was a gift from the class even though no one brought me money that they were supposed to to cover for it. And you promised that you would wear that shirt. Even after many reminders, you still refuse to wear that shirt. Thank a lot.

Now over the years, a number of things have been said in opposition to you by students who say that Ms. Hunter was better. And I defend you and your rule because you are a good man and are nice and all. However, I sometimes have to agree with them at times. You are not a bad Upper School Head, but you are unseemly strict sometimes. Whether it be cancelling Spring Fest cause it's not educational enough, taking out the vending machines, turning the break room into a "teacher's room," or even this deletion of Aaron's LJ, these decisions are in one word: absurd. I mean come on. How can you possibly do these things. Do you want to make Head-Royce suck, just like everyone says it does? Nooooo. So then dont make rash decisions and abuse your power by threatening students with expulsion for saying things which could be seen as "derogatory" to another student. First ammendment is freedom of speech my friend and even though that right of ours is oppressed everywhere else, how can you oppress it in this school which I like so much. This is ridiculous.

I'm just so upset with your latest decision that I can't think of what to say. Come on and be reasonable. Oh and since you are reading this anyways, maybe you can ask Dr. Enelow why he plays favorites and has this insane grudge against me. That'd be great, thanks.

You cannot control our lives outside of school. So don't even try. And if you are thinking of ways to threaten me, try cutting of my scholarship. That would be fair and reasonable wouldn't it? I end with a statement made by my friend Joe: "In closing, this is bullshit."

Okay, it has finally become apparent to me that the inhabitants of Head-Royce DO NOT CARE about girls volleyball. All this week there have been big deal sporting event thingys going on i.e. Boys Soccer Championships, Boys Soccer After Championships Game thing, Cross Country Championships and probably other stuff too, but i don't keep up on sports as religiously as i should...HOWEVER, ontop of all these other "important" sportign events the girls volleyball team had their last game against CPS who's like our biggest rival. Yet do classes get let out early to cheer as our team runs down the hall and up to the gym? NO. Does "eye of the tiger" get played during lunch by two of the seniors on drums and guitar as we parade through the main hall and out to the gym? NO. Do people make hour long trecks to Napa to watch a 7pm game in the freezing cold for us and put their completion of homework in jepoardy? FUCK NO. I'm fucking sick of volleyball being looked down upon. And fuck everyone who thinks it's not a sport. And what chess is??? I'm beyond bitter right now, I'm BLOODY FUCKING IRATE.

damn its been a long day...

so i figured out that i've got a huge road ahead of me if i want to do all the things i wanted to do in college. i kno that sounds vague but thats how i feel right now - vague. halloween is tomorrow. wow. which means that i am getting absolutely 0 hours of work done from Friday afternoon to Sunday morning. haha. college is fun that way.

on the plus side, my day has been one of the best so far. and that's saying something. i guess it has something to do with 1) staying up all night to write the first and final draft of an anthro paper, and getting an A- on it in spite of that, 2) Actually being able to take the Sex in French Renaissance Literature class next semester, 3) not having a calc problem set due tomorrow for which i would have to stay up until 5 AM (yes, 5 AM), 4)girls, 5)Halloween tomorrow, 6)Dhamaka show and subsequent after-party on saturday, 7) watching a 3 hour Family Guy Marathon in Huntsman Hall (the Wharton building, and the second most technologically advanced building in the country next to the CIA building, or so I hear), or 8) all of the above.

and yea, i know i'm posting in the headroyce journal, but whatever. i figure i'm in such a good mood i'd let every-fuckin-one know. even if they dont know me. haha.
